1. Introduction and Scope
1.1This Privacy Policy describes how Jade Funding Group, Inc. ("Jade," "we," "us" or "our") collects, uses, discloses and protects personal information in connection with jadefundinggroup.com (the "Site"), Applications, and our telephone calls, text messages, emails and website chat (together with the Site, the "Services").
1.2This Privacy Policy applies to business owners, officers, guarantors, authorized representatives and other individuals who visit the Site or interact with us in connection with a Business's request for commercial financing. The Services are offered for business purposes only.
1.3This Privacy Policy is part of our Terms of Use. Capitalized terms that are not defined here, such as "Application," "Business" and "Funding Provider," have the meanings given in the Terms of Use.
2. Who We Are
2.1Jade Funding Group, Inc. is located at 18 Cox Cro Rd, Toms River, NJ 08755. We help Businesses obtain commercial financing from independent Funding Providers, which make their own decisions about whether to offer financing and on what terms.
2.2Jade is compensated by Funding Providers through referral fees. Businesses do not pay Jade any fee.
3. Information We Collect
3.1The categories of personal information we collect, with examples and the sources from which we collect them, are described below.

3.2Sensitive information. Government-issued identification numbers and Social Security numbers are collected only when needed to process an Application or verify identity, and are disclosed only to Funding Providers and service providers that need them for that purpose.
4. How We Use Information
We use personal information to:
- (a) process Applications and identify Funding Providers that may offer financing to the Business;
- (b) communicate with you by telephone, text message, email and chat about your Application and the Services;
- (c) verify identity and the information you provide, and detect and prevent fraud;
- (d) maintain records and comply with legal, regulatory and contractual obligations;
- (e) operate, secure, maintain and improve the Site and the Services; and
- (f) enforce our Terms of Use and protect the rights, property and safety of Jade, our users and others.
5. Credit Information
5.1Jade does not obtain your personal or business credit report when you submit an Application through the Site. A Funding Provider may ask you, or any owner or guarantor of the Business, to authorize it to obtain credit reports as part of its own review. Any such authorization is between you and that Funding Provider and is governed by its privacy policy and applicable law.
6. How We Disclose Information
We may disclose personal information to the following categories of recipients:
- (a) Funding Providers. We disclose Applications and related information and documents to Funding Providers, at your direction and on your behalf, to seek financing offers for the Business. Funding Providers may retain and use that information in accordance with their own privacy policies, whether or not they make an offer or you accept one.
- (b) Service providers. We disclose information to companies that perform services for us, such as website hosting, advertising measurement, data storage, email, telephone and text messaging, and identity verification. They are permitted to use the information only to perform services for us.
- (c) Professional advisors. We may disclose information to our attorneys, accountants and auditors in the course of their services to us.
- (d) Legal and safety. We may disclose information when we believe it is required by law, subpoena or other legal process, or necessary to protect the rights, property or safety of Jade, our users or others, including to prevent fraud.
- (e) Business transfers. We may disclose information in connection with a merger, acquisition, financing or sale of all or part of our business, in which case the information will remain subject to this Privacy Policy.
- (f) With your consent. We may disclose information to other parties when you direct or consent to it.
6.1We may also use and disclose information that has been de-identified or aggregated so that it no longer identifies any individual.
7. Text Messaging
7.1If you opt in to receive text messages from Jade, we use your mobile number to send messages about your Application and the Services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Our full text message program terms are in Section 12 of our Terms of Use.
7.2No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. The categories of recipients described in Section 6 exclude text messaging originator opt-in data and consent.
9. No Sale of Personal Information
9.1Jade does not sell personal information and does not share personal information for cross-context behavioral advertising. The Google Ads tag described in Section 8 is used only to measure our advertising, with advertising personalization turned off. When we disclose an Application to Funding Providers, we do so at your direction and on your behalf to seek financing for the Business.
10. Data Security
10.1We maintain reasonable administrative, technical and physical safeguards designed to protect personal information, including encrypted connections and access limited to personnel who need it to perform their duties. No method of transmission or storage is completely secure, and we cannot guarantee the security of information transmitted to us. Please do not send full account numbers, Social Security numbers or passwords through the chat or by text message.
11. Data Retention
11.1We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy. In determining retention periods, we consider the length of our relationship with you and the Business, our legal, regulatory and record-keeping obligations, and the need to establish, exercise or defend legal claims. When information is no longer needed, we delete it or de-identify it.
12. Your Choices
- (a) Text messages. Reply STOP to any text message from Jade.
- (b) Emails. Use the unsubscribe link in any marketing email, or reply and ask to be removed.
- (c) Telephone calls. Ask your Jade representative, or email info@jadefundinggrp.com, to be placed on our internal do-not-call list.
- (d) Access, correction and deletion. You may ask to see, correct or delete the personal information we hold about you by contacting us as described in Section 18. We will verify your request before acting on it, and we may retain information where required or permitted by law.
12.1Opting out of marketing Communications does not stop Communications about an Application you have submitted.
13. Your Privacy Rights
13.1Depending on where you live, you may have rights under applicable state privacy laws, such as the right to know, access, correct or delete personal information, and the right to appeal a decision about your request. To make a request, contact us as described in Section 18. We will not discriminate against you for exercising any of these rights.
13.2Nevada residents. Jade does not sell covered information as defined under Nevada law.
14. Children
14.1The Site and the Services are intended for individuals 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us and we will delete it.
15. Third-Party Websites and Services
15.1The Site may link to websites and services operated by third parties, including Funding Providers. Their collection and use of information is governed by their own privacy policies, and we are not responsible for their practices.
16. Users Outside the United States
16.1The Services are intended only for Businesses in the United States, and personal information is stored and processed in the United States.
17. Changes to This Privacy Policy
17.1We may update this Privacy Policy from time to time. The updated Privacy Policy will be posted on the Site with a new "Last Updated" date. If we make material changes, we will provide additional notice, such as a notice on the Site or by email.
